SAMPLE CONTRACT 1. The Breeder agrees to sell the following cat/ kitten
Purchaser agrees: _______ Agreement is entered into between Tylene Mackay, and Purchaser for their mutual protection and 'ESPECIALLY FOR THE PROTECTION AND WELL-BEING OF THE CAT'. It is mutually understood that failure to comply with any provision of this agreement can and will result in legal action. Breeder is INTENSELY interested in the welfare of every cat sold. Therefore, this contract details what is REQUIRED for all cat purchases... * Purchaser is encouraged to call whenever there is a question or concern about their new Maine Coon cat or kitten. _________ Purchaser agrees to keep this cat as long as he/she lives unless unforeseen circumstances prevent. In such circumstances, the Breeder reserves the option for return of this cat to her. Breeder will select an appropriate home for the kitten/cat. If Breeder re-sells this cat, the purchase price, less Breeder expenses, ‘will be refunded’ to the Purchaser. If the Purchaser has a new home in consideration for the cat/kitten, the Purchaser will advise the breeder of such preparations, and the new caretakers contact information. No Health Guarantee will extend. The Purchaser agrees that under no circumstances will said cat/kitten be: sold or given to a pet store, Research Facility, or animal shelter, nor will it be abandoned to fend for itself. _________ Purchaser agrees that this cat is to be a house cat only and live indoors exclusively. The Purchaser agrees not to let the cat/kitten run loose outdoors. _________ Purchaser agrees to provide adequate space, exercise, food, fresh water, and litter. The Purchaser agrees to provide adequate health care for the cat/kitten, including annual immunizations, keeping the cat/kitten free from internal and external parasites and consult with a Veterinarian upon sign of illness. ________ Purchaser agrees claws will be clipped on a weekly or bi-weekly basis as needed. A tall scratching post is necessary, and will be provided. This cat ‘will not’ be declawed. The Breeder will provide adequate council and advise the Purchaser if this ever becomes an issue. If for any reason the Purchaser has the cat/kitten declawed, the Breeder cannot and ‘shall not’ be held responsible for any ill effects this may have on the cat/kitten. This act without counsel will give cause for the Breeder to nullify and void ‘any and all’ written or verbal health guarantees. ________ The Purchaser agrees that this cat will not be left alone for more than 24 hours unless arrangements are made with a responsible party to provide fresh food and water daily, and fresh litter as needed. _______The classification of this cat/kitten, is indicated as PET or SHOW/ALTER in item 1.F. above, the Purchaser shall have the cat/kitten spay/neutered by the age of 6-8 months for female and 8-10 months for male. THIS CAT DOES NOT HAVE ANY BREEDING RIGHTS whatsoever. Neutering or spaying is 'REQUIRED'. Purchaser agrees not to allow this cat to produce offspring and if this cat is found to have been bred, this cat & any & Breeder may also claim all progeny from this cat in the Purchaser’s possession. Although, this cat is healthy, to the best of Breeders knowledge, Breeders REQUIRES that this cat not be bred-as any and all pets not in a viable breeding program should not be allowed to breed. Breeder is not responsible for any traits, breeding, or offspring traits of this cat. Registration papers ‘will not be released’ until Purchaser provides to Breeder, a valid signed vet statement of proof of Spay/Neuter. ** A licensed Veterinarian must perform this operation and a written statement by the Veterinarian must be sent to the Breeder that confirms the operation. Breeder will call vet to Confirm Spay/Neuter. Upon receipt of this documentation, the Breeder will then mail the registration papers to the Purchaser. The cat/kitten ‘must not be allowed to breed’. If the cat/kitten is allowed to breed, the Breeder reserves the right to take any necessary actions to make claim on any offspring or financial gain from this severe breach of contract, and demand the return of the cat/kitten. ________The Purchaser agrees to advise the Breeder at least twice annually during the first two years and at least annually thereafter of the cat's development and progress. Purchaser understands that they should provide photographs for the Breeder to aid in their evaluation of the breeder’s breeding program.
Health Guarantee: The breeder makes no guarantee on the health of this cat/kitten except as follows: _______ Breeder provides the cat with current vaccinations for Rhinotracheitis, Calici Virus, Panleukopenia, and worming. _______ The Breeder guarantees that the cat/kitten is in good health at the time of purchase and free from any internal or external parasites. Unless otherwise stated.Please see health records for vaccinations and any other health related information. _______ Since some hereditary/congenital problems do not surface until the cat is older, and we have no way of detecting them at an earlier age. Until a DNA test is available for detecting HCM, sonogram and electrocardiogram are the best means of early detection. Therefore, it is recommended that this cat be sonogrammed at least 1 time before the 3rd birthday of this cats life. The breeder will guarantee against any life threatening or severe** genetic health problems in this cat/kitten for the first 3 years of this cats life. Upon a Veterinarians confirmation of such onset, the Breeder will at the return of cat/kitten, replace the cat/kitten as soon as a suitable cat/kitten is available. Should Purchaser decide to keep said cat and accept partial refund, Breeder will, upon receipt of proof, refund 50% (Fifty percent) of purchase price. This is a limited warranty; any claims under this guarantee, must be made in the first 3 years of purchase. ** This indicates any genetic defect that would interfere with the purpose of which this cat/kitten was intended as indicated in section 1F on page 1. Severe or life threatening does not include such things as a kinked tail or polydoctal toes unless the cat/kitten is purchased as a “For showing” pet. _______ Vaccination with the feline leukemia (FELV) should be given at the purchasers own risk and the breeder cannot be held responsible for any vaccination related complications. _______ Vaccination with the FIP vaccines VOIDS ALL HEALTH WARRANTIES. _______ The Health guarantee on "FIP" is limited to the age of one year of age. Feline Leukemia guarantee is limited to the age of four (4) months or three (3) days (72 hours) once possession has been passed, which ever comes first. These restrictions are because Breeder has NO control over what pet is exposed to after leaving Breeder's home. All Adult cats have been tested & found negative for Feline Leukemia, unless otherwise stated; there are NO accurate tests for FIP. NOTE: Breeder reserves the right to confirm diagnosis AND TREATMENT PROTOCOL for appropriateness to the diagnosis, and confirm that, if said protocol is appropriate, the protocol is being followed. The Breeder reserves the right to have the cat/kitten checked by a Veterinarian of her choice to confirm the diagnoses under any of the terms of the Health Guarantee. Further more if any of the terms of this contract are not fully met the Purchaser risk the loss of the health guarantee and or the cat/kitten. If the cat/kitten shows any physical or behavioral indications to having been mistreated or neglected at any time under the care of the Purchaser, the Purchaser must surrender the cat/kitten to the Breeder immediately. _______Extended health not guaranteed beyond the terms of this agreement. Due to the fact that Breeder no longer has complete control of the cat, it is environment, health care, or diet. _______ Initial here to confirm that the purchaser has fully read, and agrees to the terms of this contract, asked any questions and received full explanations on any of the terms stated. Purchaser agrees to the above listed restrictions and conditions (listed above) as written without modification to this contract. All parties signing this contract consider this document to be legally binding.
